1. Acceptance of Terms

By accessing or using WowCoach.gg (the "Service"), you agree to be bound by these Terms and Conditions ("Terms") with WowCoach, LLC ("WowCoach," "we," "us," or "our"), a Texas limited liability company that owns and operates WowCoach.gg. If you do not agree to these Terms, you may not access or use the Service. We reserve the right to modify these Terms at any time, and your continued use of the Service constitutes acceptance of any modifications.

You must be at least 13 years of age to use this Service. By using the Service, you represent and warrant that you are at least 13 years old.

2. Service Description

WowCoach.gg is a combat log analytics platform for World of Warcraft that provides performance analysis, statistics, leaderboards, and AI-powered coaching. The Service analyzes combat log files generated by the World of Warcraft game client and provides insights based on that data.

The Service is currently in alpha/beta testing. Features, functionality, and pricing may change at any time without notice. We make no guarantees about the availability, accuracy, or completeness of the Service during this testing period.

3. User Accounts and Registration

To access certain features of the Service, you may be required to create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account
• Providing accurate, current, and complete information during registration

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or illegal activity.

4. User Data and Privacy

By uploading combat logs or connecting your Battle.net account, you grant us permission to:

• Process and analyze combat log data
• Store character names, performance statistics, and gameplay data
• Display this information publicly on leaderboards and reports
• Use aggregated, anonymized data to improve the Service

In accordance with Blizzard Entertainment's policies, character names, character data, and character profile information are owned by Blizzard Entertainment and are not protected as personal information. This data may be publicly displayed on our Service.

5. User-Generated Content

Content you upload to the Service, including combat logs, comments, and feedback ("User Content"), remains your property. However, by uploading User Content, you grant us a worldwide, non-exclusive, royalty-free license to:

• Use, reproduce, modify, and display the User Content
• Create derivative works based on the User Content for the purpose of providing the Service
• Store and process the User Content on our servers

You represent and warrant that you have all necessary rights to upload User Content and grant us this license. You agree not to upload any content that:

• Violates any law or regulation
• Infringes on intellectual property rights of others
• Contains viruses, malware, or other harmful code
• Is false, misleading, or fraudulent
• Harasses, threatens, or defames others

6. Intellectual Property Rights

The Service, including its design, code, algorithms, features, and content (excluding User Content), is owned by WowCoach, LLC and is protected by copyright, trademark, and other intellectual property laws.

World of Warcraft, WoW, and all related content are trademarks and copyrights of Blizzard Entertainment, Inc. WowCoach.gg is not affiliated with, endorsed by, or sponsored by Blizzard Entertainment. All character data, spell names, item names, and game mechanics referenced in the Service are the property of Blizzard Entertainment.

You may not copy, modify, distribute, sell, or create derivative works of the Service or its content without our express written permission.

7. API Usage and Rate Limits

If you access the Service through our API, you agree to:

• Comply with all rate limits and usage restrictions
• Not attempt to circumvent or bypass rate limits
• Not use the API for any commercial purpose without prior written consent
• Not scrape, crawl, or systematically extract data from the Service
• Properly attribute data obtained from the API to WowCoach.gg

We reserve the right to revoke API access at any time for violations of these Terms or excessive usage that impacts Service performance.

8. Subscription and Payment Terms

Certain features of the Service require a paid subscription. By subscribing, you agree to:

• Pay all fees associated with your subscription plan
• Provide accurate and current billing information
• Automatic renewal of subscriptions unless cancelled prior to the renewal date

Payment processing is handled by Paddle.com Market Limited ("Paddle"), our authorized payment processor. By subscribing, you also agree to Paddle's terms of service and privacy policy. We do not store your credit card or payment information.

We reserve the right to change subscription prices at any time. Price changes for existing subscriptions will be communicated at least 30 days in advance and will take effect at your next renewal date.

Refund Policy:

Refunds may be provided at our discretion in the following circumstances:

• Service outages exceeding 24 consecutive hours
• Billing errors or duplicate charges
• Cancellation within 7 days of initial subscription (first-time subscribers only)
• Other exceptional circumstances evaluated on a case-by-case basis

9. Disclaimers and Limitations of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• Merchantability and fitness for a particular purpose
• Non-infringement of third-party rights
• Accuracy, completeness, or reliability of the Service
• Uninterrupted or error-free operation
• Security of data transmission or storage

IN NO EVENT SHALL WOWCOACH, LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, or data
• Loss of use or opportunity
• Business interruption
• Cost of substitute services

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.

10. Indemnification

You agree to indemnify, defend, and hold harmless WowCoach, LLC, its officers, directors, employees, and agents from any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Any User Content you upload or submit

11. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice, for any reason including but not limited to:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Non-payment of fees
• At our sole discretion

You may terminate your account at any time by contacting us at support@wowcoach.gg or through your account settings. Upon termination, your right to use the Service will immediately cease, and we may delete your account and User Content.

Provisions of these Terms that by their nature should survive termination will survive, including but not limited to: intellectual property rights, disclaimers, limitations of liability, and indemnification.

12. Third-Party Services

The Service integrates with third-party services, including but not limited to:

• Battle.net API (Blizzard Entertainment)
• AWS Bedrock (Amazon Web Services)
• Paddle (payment processing)
• AWS infrastructure services

Your use of these third-party services is subject to their respective terms and conditions. We are not responsible for the availability, accuracy, or reliability of third-party services.

13. Compliance with Blizzard's Terms of Service

WowCoach.gg operates in compliance with Blizzard Entertainment's Terms of Service and End User License Agreement. The Service:

• Only analyzes combat log files generated by the game client
• Does not modify the game client or read game memory
• Does not automate gameplay or provide unfair advantages
• Uses only officially supported APIs (Battle.net API)

You acknowledge that using the Service is at your own risk and that we make no guarantees regarding compliance with Blizzard's evolving policies.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.

For Residents of the United States and Other Non-EU Jurisdictions:

Any disputes arising from or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in Texas. Both parties agree to waive their right to a jury trial. Either party may seek injunctive relief in court to protect intellectual property rights.

For Residents of the European Economic Area:

If you are a resident of the European Economic Area, the arbitration provision above does not apply to you. You retain all rights granted under applicable EU consumer protection laws. Disputes will be resolved in accordance with the mandatory consumer protection laws of your country of residence, and you retain the right to bring proceedings in the courts of your EU member state.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by:

• Updating the "Last Updated" date at the top of this page
• Sending an email notification to registered users
• Posting a notice on the Service

Your continued use of the Service after such modifications constitutes acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Service and may terminate your account.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole. Such provisions shall be deleted without affecting the remaining provisions.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and WowCoach, LLC regarding the Service and supersede all prior agreements, understandings, and communications, whether written or oral.
